CONSIDERED FACTORS

Risk factors considered include, but are not limited to:

    • Nature and severity of the violation, including but not limited to:
      • Use of a weapon
      • Use of force
      • Use of coercion
      • Amount of substance used or present (for substance use violations)
    • Impact on the community, including but not limited to:
      • Extent of physical or emotional harm caused
      • Potential for physical or emotional harm
    • Past contact with the Center for Community Standards, including past educational remedies assigned
    • Need for protection of the community
    • Need for protection of the respondent
    • Institutional Precedent

Extenuating factors considered include, but are not limited to:

    • Demonstration of understanding by the respondent
    • Documented behavior change
    • Circumstances leading to the behavior (such as death in the family, mental health crisis, fundamental needs issue, etc.)
    • Disparate impact of the outcome on the respondent
